h1. Annual Diary Terms of Service

These Terms of Service govern your use of Annual Diary, a diary application developed and provided by Annual Diary Project.

By using Annual Diary, you agree to these Terms. If you do not agree with these Terms, please do not use the application.

h2. 1. Description of the Service

Annual Diary is a diary application that allows users to create, view, edit, and manage diary entries organized by month and day.

The application may provide the following features:

* Storage of diary text and image files on the user's device

* Synchronization of diary data with the user's Google Drive

* Recovery of diary data from Google Drive

* Conflict detection when the same diary is edited on multiple devices

* Advertisements in the standard version

* An optional ad-free subscription in applicable Android versions

* A premium version without advertisements where available

Some features may differ depending on the operating system, application version, or distribution platform.

h2. 2. User Accounts and Third-Party Services

Some cloud synchronization features require a Google Account.

When you connect Annual Diary to Google Drive, you authorize the application to access the Google Drive data necessary to provide the synchronization features. Your use of Google 

Drive is also subject to Google's applicable terms and policies.

Annual Diary does not require you to create an account with the developer.

h2. 3. User Content

You retain ownership of the diary text, images, and other content that you create or store using Annual Diary.

You grant the developer a limited, non-exclusive permission to process your content only as necessary to provide the features you request, including local storage, synchronization, recovery, and conflict handling.

The developer does not claim ownership of your diary content.

You are responsible for keeping appropriate backups of important content.

h2. 4. Google Drive Synchronization

Google Drive synchronization is performed at the user's request or according to synchronization settings configured by the user.

Synchronization may fail or be delayed because of network problems, Google Drive availability, authentication problems, insufficient storage, application errors, or other circumstances outside the developer's control.

The developer does not guarantee that synchronization will always be completed successfully or immediately.

h2. 5. Paid Features and Subscriptions

Some versions of Annual Diary may offer paid features or an ad-free subscription.

Payments, billing, automatic renewal, cancellation, refunds, and eligibility are handled through the applicable application store, such as Google Play. The applicable store's terms and policies also apply.

The availability and price of paid features may differ by country, operating system, application version, and distribution platform.

h2. 6. Advertisements

The standard version of Annual Diary may display advertisements.

The premium version or an active ad-free subscription may remove advertisements as described in the relevant application store or application screen.

The developer is not responsible for the content, availability, or accuracy of advertisements provided by third-party advertising services.

h2. 7. Prohibited Use

You must not:

* Use Annual Diary in violation of applicable laws or regulations

* Attempt to interfere with or damage the application or its services

* Reverse engineer or misuse the application except where permitted by applicable law

* Use the application to store or distribute unlawful content

* Circumvent payment, access-control, or security mechanisms

* Use the application in a way that infringes the rights of others

h2. 8. Intellectual Property

Annual Diary, including its software, design, logos, names, and related materials, is owned by or licensed to the developer and is protected by applicable intellectual property laws.

These Terms grant you a limited, non-transferable right to use the application for its intended purpose. They do not transfer ownership of the application or its intellectual property to you.

h2. 9. Changes, Suspension, and Termination

The developer may update, modify, suspend, or discontinue all or part of Annual Diary when reasonably necessary.

The developer may suspend or terminate access if you materially violate these Terms, misuse the application, or create a security or legal risk.

If you stop using the application, you may disconnect Google Drive access and delete local application data from your device. Revoking Google Drive access from your Google Account is also recommended.

h2. 10. Disclaimer

Annual Diary is provided on an “as is” and “as available” basis to the extent permitted by law.

The developer does not warrant that the application will always be uninterrupted, error-free, secure, or compatible with every device or operating system.

You should maintain backups of important diary data and should not rely on Annual Diary as the only copy of important information.

h2. 11. Limitation of Liability

To the maximum extent permitted by applicable law, the developer will not be liable for indirect, incidental, special, consequential, or loss-of-data damages arising from or related to your use of Annual Diary.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

h2. 12. Changes to These Terms

The developer may update these Terms when the application, services, laws, or business practices change.

The updated Terms will be published on this page with a revised effective date. Continued use of Annual Diary after the updated Terms take effect means that you accept the updated Terms.

h2. 13. Governing Law and Contact

These Terms are governed by the laws of Japan, unless applicable law requires otherwise.

本利用規約は、Annual Diary Projectが開発・提供する日記アプリ「毎年日記」の利用条件を定めるものです。

毎年日記を利用することにより、本規約に同意したものとします。本規約に同意しない場合は、本アプリを利用しないでください。

h2. 1. サービスの内容

毎年日記は、月日ごとに整理された日記を作成、表示、編集、管理するためのアプリです。

本アプリでは、次の機能を提供する場合があります。

* 日記本文および画像ファイルの端末内保存

* 利用者のGoogle Driveとの日記データの同期

* Google Driveからの日記データの復元

* 複数端末で編集した日記の競合検出

* 通常版における広告表示

* 対応するAndroid版における広告非表示サブスクリプション

* 広告を表示しないプレミアム版

利用できる機能は、OS、アプリのバージョン、配布プラットフォームなどによって異なる場合があります。

h2. 2. 利用者アカウントと第三者サービス

クラウド同期機能の一部を利用するには、Googleアカウントが必要です。

毎年日記をGoogle Driveに接続すると、利用者が要求した同期機能を提供するために必要な範囲で、アプリによるGoogle Driveへのアクセスを許可することになります。Google Driveの利用には、Googleが定める規約およびポリシーも適用されます。

毎年日記を利用するために、開発者が管理するアカウントを作成する必要はありません。

h2. 3. 利用者のコンテンツ

利用者が毎年日記で作成・保存する日記本文、画像その他のコンテンツの権利は、利用者に帰属します。

利用者は、端末内保存、同期、復元、競合処理など、利用者が要求した機能を提供するために必要な範囲で、開発者がコンテンツを処理することを許諾します。

開発者は、利用者の日記コンテンツの所有権を取得しません。

重要なコンテンツについては、利用者自身が適切なバックアップを作成してください。

h2. 4. Google Driveとの同期

Google Driveとの同期は、利用者の操作または利用者が設定した同期条件に従って実行されます。

ネットワーク障害、Google Driveの障害、認証エラー、保存容量不足、アプリの不具合その他の開発者が管理できない事情により、同期が失敗または遅延する場合があります。

開発者は、同期が常に成功すること、または直ちに完了することを保証しません。

h2. 5. 有料機能とサブスクリプション

毎年日記の一部のバージョンでは、有料機能または広告非表示サブスクリプションを提供する場合があります。

支払い、請求、自動更新、解約、返金および利用条件は、Google Playなどの利用するアプリストアを通じて処理されます。各アプリストアの規約およびポリシーも適用されます。

有料機能の提供状況および価格は、国、OS、アプリのバージョン、配布プラットフォームなどによって異なる場合があります。

h2. 6. 広告

毎年日記の通常版では、広告が表示される場合があります。

プレミアム版または有効な広告非表示サブスクリプションでは、アプリストアまたはアプリ画面に記載された範囲で広告が非表示になります。

第三者の広告サービスが提供する広告の内容、提供状況、正確性について、開発者は責任を負いません。

h2. 7. 禁止事項

利用者は、次の行為をしてはいけません。

* 法令または規則に違反して毎年日記を利用すること

* アプリまたはサービスを妨害・破壊しようとすること

* 法令で認められる場合を除き、アプリをリバースエンジニアリングまたは不正利用すること

* 違法なコンテンツの保存・配布に利用すること

* 支払い、アクセス制御、セキュリティ機能を回避すること

* 他者の権利を侵害する方法で利用すること

h2. 8. 知的財産権

毎年日記のソフトウェア、デザイン、ロゴ、名称および関連資料に関する権利は、開発者または正当なライセンサーに帰属します。

本規約は、所定の目的でアプリを利用するための限定的かつ譲渡不可の権利を許諾するものであり、アプリや知的財産権の所有権を利用者へ移転するものではありません。

h2. 9. 変更、停止、終了

開発者は、必要と合理的に判断した場合、毎年日記の全部または一部を更新、変更、停止または終了することがあります。

利用者が本規約に重大な違反をした場合、アプリを不正利用した場合、またはセキュリティ・法的リスクを生じさせた場合、開発者は利用を停止または終了することがあります。

利用を終了する場合、利用者はGoogle Driveの接続を解除し、端末からアプリのデータを削除できます。Googleアカウント側からGoogle Driveへのアクセス権を取り消すことも推奨します。

h2. 10. 免責

法令で許される範囲で、毎年日記は「現状有姿」かつ「提供可能な範囲」で提供されます。

開発者は、アプリが常に中断なく動作すること、エラーがないこと、安全であること、すべての端末またはOSと互換性があることを保証しません。

重要な日記データについては、利用者自身がバックアップを保管してください。

h2. 11. 責任の制限

適用法で認められる最大限の範囲で、開発者は、毎年日記の利用に関連して生じた間接損害、付随的損害、特別損害、結果的損害またはデータ消失について責任を負いません。

ただし、法令上、免責または責任制限が認められない責任については、この限りではありません。

h2. 12. 本規約の変更

開発者は、アプリ、サービス、法令または事業内容の変更に応じて、本規約を変更することがあります。

変更後の規約は、本ページに新しい施行日を付けて掲載します。変更後の規約の施行日以降も毎年日記を利用した場合、変更後の規約に同意したものとします。

h2. 13. 準拠法と連絡先

本規約には、適用法で別段の定めがある場合を除き、日本法を適用します。
